Judge Dismisses Blixseth Lawsuit Against Atigeo, xPatterns and Companies’ Directors And Officers Lawsuit dismissed with prejudice in its entirety
Bellevue, Wash. — August 25, 2008 — Atigeo LLC, a technology innovator, today announces that the lawsuit filed by Edra Blixseth in King County Superior Court against Atigeo LLC, xPatterns LLC, Michael Sandoval, and the directors and certain officers of those companies (Cause No. 08-2-18034-4SEA) ("the Lawsuit”) was dismissed with prejudice in its entirety on Friday, August 22, 2008. Blixseth filed the lawsuit based on numerous instances of alleged wrongdoing.
All of the named defendants filed motions asking the Court to dismiss the lawsuit. On August 22, the motions were heard in front of The Honorable Joan E. DuBuque. Following oral argument on the motions, Judge DuBuque issued her ruling in open court, granting defendants all motions, thereby dismissing all of Blixseth’s claims as a matter of law.
"The dismissal by the King County Superior Court of the action brought by Ms. Blixseth is a decisive legal victory for Atigeo and the other defendants," said Atigeo’s attorney, Brian C. Park of Dorsey & Whitney LLP. "We are very pleased with the Court’s decision."
When ruling on a motion to dismiss, the rules of the Court require that the benefit of the doubt be given to the plaintiff, Edra Blixseth, and that all her factual allegations be assumed to be true, regardless of any factual disputes. Even assuming the truth of those allegations, the Court still ruled that Blixseth did not have any legal basis to bring a claim against any of the defendants.
In addition, the Court also granted Atigeo’s and xPatterns’ separately filed motion to strike portions of Blixseth’s original and amended complaints, determining that allegations made by Blixseth were immaterial, impertinent, and scandalous.
